This Privacy Policy describes sold-out.net (the “Site” or “we”) collects, uses, and discloses your Personal Information when you visit or make a purchase from the Site.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognise and approve any follow-up comments automatically instead of holding them in a moderation queue.

Personal data that we process

When placing an order via our webshop, Sold Out asks for the following personal data:

  • First and last name
  • Address data
  • Email address
  • Bank account number

Because people visit Sold Out’ website Sold Out only processes these visitors’ personal data, because this information is then provided by the visitors to Sold Out to process the order. Besides the fact that we do not deliberately collect any personal and/or sensitive personal data, we also do not collect data from youths under the age of 16. We cannot check whether a visitor is younger than 16, and we do not know whether information is unintentionally received by us. We therefore advise parents to be involved in the online activities of their children, in order to prevent data about children being collected without parental consent. If you are convinced that we have collected personal information about a minor without this permission, please contact us at info@sold-out.net and we will delete this information.

For what purpose and on what basis we process personal data

Sold Out processes your personal data for the following purposes:

  • Payment processing
  • In order to call or e-mail a customer if this is necessary to be able to carry out our services
  • To deliver goods and services to a customer
  • If we are legally obliged to do so, such as data that we legally need for our tax declarations

Sharing of personal data with third parties

Sold Out does not sell nor share visitors’ data to third parties and will only provide visitors’ data to third parties if this is necessary for the execution of our agreement with a visitor or to comply with a legal obligation.

Sold Out only uses technical and functional cookies. A cookie is a small text file that is stored on a visitor’s computer, tablet or smartphone when they first visit this website. The cookies we use are necessary for the technical functioning of the website and their ease of use. They ensure that the website works properly and remembers a visitor’s preferred settings. We can also optimise our website using cookies. The visitor can opt out of cookies by changing the settings in their internet browser so that it no longer stores cookies. In addition to this, a visitor can also delete all information that has previously been stored via the settings of their browser.

View, modify or delete data

The visitor has the right to view, correct or delete their personal data. Additionally, they have the right to withdraw their consent to the data processing or to object to the processing of their personal data by Sold Out and have the right to data transferability. This means that a visitor can submit a request to Sold Out to send the personal data we have about them in a computer file to the person themself or to another organisation named by them.

The visitor can request access, correction, deletion, transferral of their personal data or request for withdrawal of their consent to the processing of their personal data to info@sold-out.net. To ensure that the request for access has been made by the visitor, we ask that they send a copy of proof of identity along with the request. In this request, the passport photo, MRZ (machine readable zone, the strip with numbers at the bottom of the passport), passport number and Social Security Number should be blacked out. This is to protect the visitor’s privacy. We will respond to the visitor’s request as soon as possible, but within four weeks at the latest.

We DO NOT engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

Our processor Woocommerce uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

Services that include elements of automated decision-making include:

  • Temporary denylist of IP addresses associated with repeated failed transactions. This denylist persists for a small number of hours.
  • Temporary denylist of credit cards associated with denylisted IP addresses. This denylist persists for a small number of days.

Sold Out takes the protection of visitors’ data seriously and takes appropriate measures to counter misuse, loss, unauthorised access, unwanted disclosure and unauthorised modification.
